Terms of Service

These Terms of Service ("Terms") govern your use of the Lume website at lumesend.com and the Lume email engine software ("Service") provided by Lume ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website, joining the waitlist, or using the Lume software, you confirm that you are at least 16 years of age and agree to comply with these Terms. If you do not agree, do not use the Service.

2. Description of Service

Lume is a self-hosted email engine distributed as a Docker-based software package. The Service includes:

• Access to the Lume software under a monthly license ($49/month).
• Software updates and feature releases during your active subscription.
• Access to documentation, setup guides, and the domain health checker tool.
• Priority email support for licensed users.

Lume is a self-hosted product. You are responsible for provisioning and maintaining your own server infrastructure (VPS, database, DNS configuration).

3. Account & Waitlist

• You must provide a valid email address to join the waitlist or create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and up-to-date information.

4. License & Usage

4.1 License Grant

Subject to your payment of applicable fees, we grant you a non-exclusive, non-transferable, revocable license to use the Lume software on a single server instance for your business or personal use.

4.2 Restrictions

You may not:

• Redistribute, sublicense, resell, or share your Lume license with third parties.
• Reverse-engineer, decompile, or attempt to extract the source code of proprietary components.
• Use the Service to send unsolicited bulk email (spam), phishing, or fraudulent content.
• Use the Service in violation of any applicable laws or regulations, including anti-spam laws (CAN-SPAM, GDPR, CASL).
• Attempt to circumvent license validation or usage limitations.

5. Acceptable Use

You agree to use Lume responsibly and ethically. Specifically, you agree not to:

• Send unsolicited commercial emails to purchased or scraped lists.
• Impersonate other senders or forge email headers.
• Transmit malware, viruses, or harmful content.
• Use the Service to harass, threaten, or abuse others.
• Deliberately harm email deliverability reputation for any domain.

We reserve the right to terminate your license if you violate this Acceptable Use policy.

6. Fees & Payment

• The Lume software license is billed monthly at the current rate ($49/month).
• Infrastructure costs (VPS hosting, DNS, etc.) are your responsibility and are paid directly to your hosting provider.
• All fees are non-refundable unless otherwise stated.
• We reserve the right to change pricing with 30 days' notice to active subscribers.

7. Free Tools

Our free tools (such as the Domain Health Checker) are provided "as is" without warranty. Results are based on publicly available DNS records and may not reflect the complete configuration of your domain. We do not store domain lookup data.

8. Intellectual Property

The Lume software, website, branding, documentation, and all related materials are the intellectual property of Lume. Your license does not transfer ownership of any intellectual property.

9. Limitation of Liability

To the maximum extent permitted by law:

• Lume is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
• We are not responsible for email deliverability outcomes, which depend on factors outside our control (domain reputation, content quality, recipient server policies).

10. Termination

• You may cancel your subscription at any time. Your license remains active until the end of the current billing period.
• We may terminate your license immediately if you violate these Terms or the Acceptable Use policy.
• Upon termination, you must cease using the Lume software. Your data on your own servers remains yours.

11. Modifications to Terms

We may revise these Terms at any time. Material changes will be communicated via email or the website with at least 14 days' notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes arising from these Terms will be resolved through binding arbitration.
